Loss of a spouse is not affected by the purchase of their securities if the assets are separate property

A taxpayer asks whether a capital loss resulting from the sale of his wife's shares can be included in his tax return after having purchased those same shares in less than two months. The DGT rules that the application of the rule on homogeneous securities depends on the ownership of the assets.

The DGT's ruling

Las ganancias y pérdidas patrimoniales se atribuyen a quien ostente la titularidad dominical de los bienes, independientemente de la titularidad formal en registros bancarios. Si las acciones pertenecen a la sociedad de gananciales, se aplica la norma de valores homogéneos para cada cónyuge sobre su participación. Si las acciones son privativas, la pérdida de un cónyuge no se ve afectada por la compra realizada por el otro, aunque tributen conjuntamente.
