Rental income must be taxed by the owner, even if collection is assigned to a third party

A property owner inquired whether she could freely assign the right to collect rent from her flat to her son. The DGT ruled that income must be attributed to the legal owner of the property and that assigning the collection rights triggers an additional tax.

The DGT's ruling

Los rendimientos del capital inmobiliario se atribuyen a los contribuyentes que sean titulares de los bienes de los que provienen, según las normas de titularidad jurídica. Por tanto, las rentas se imputan al propietario en proporción a su titularidad, independientemente de que el importe se ceda gratuitamente a un tercero. Además, la cesión del importe de las rentas al hijo constituye un hecho imponible del Impuesto sobre Sucesiones y Donaciones.
