A taxpayer inquired whether they could claim a 100% deduction for mortgage payments on a home acquired before marriage, even though payments are now made using community property funds. The Directorate General of Taxes (DGT) ruled that, as these are community funds, the amount of each payment must be attributed equally to each spouse.
Cuestión planteada Si el consultante tiene derecho a la deducción por inversión en vivienda habitual en función del 100% de las cantidades satisfechas por el préstamo hipotecario o por la mitad de dichas cantidades.
Para la deducción por inversión en vivienda habitual, se requiere la propiedad de la vivienda y que esta sea la residencia habitual. En régimen de gananciales, si la vivienda es familiar, la propiedad se distribuye según las aportaciones de cada cónyuge y de la sociedad. Los pagos realizados con fondos gananciales para amortizar un préstamo hipotecario deben imputarse al 50% a cada cónyuge, independientemente de quién sea el titular de la cuenta bancaria. El cónyuge que adquirió la vivienda antes del matrimonio solo podrá deducirse la mitad de los pagos hechos con fondos gananciales y la parte correspondiente a sus propios fondos privativos.
