IRPF · exención por reinversión

The exemption for reinvestment in the construction of a new dwelling may be applied if deadlines and conditions are met

The taxpayer asks whether the reinvestment exemption can be applied by selling their current dwelling to purchase one under construction. The DGT clarifies that this is possible provided that the reinvestment deadlines are met and the construction is completed within the established legal period.

The question raised

Question posed: Whether the reinvestment exemption is applicable.

The DGT's ruling

For the exemption regarding the construction of a dwelling, a dual condition must be met: 1) the total amount must be reinvested within a period of two years (prior to or following the sale) and 2) the construction must be completed within a period not exceeding four years from the commencement of the investment. Payments made outside the two-year period prior to the sale shall not be counted as reinvestment. If the reinvestment is partial, only the proportional part of the gain shall be excluded.
