Property sale classification depends on production and human resources organisation

The DGT clarifies whether occasional property transactions should be treated as economic activity or as patrimonial gains. If there is organisation of production means or human resources, it is considered economic activity; otherwise, it is a patrimonial gain.

The question raised

Question as to how the income obtained from the sale of such real estate should be classified, specifically whether it is considered capital gains and losses for the purposes of Personal Income Tax.

The DGT's ruling

If the sale and purchase of real estate involves the self-organization of means of production and human resources, or one of the two, it is considered an economic activity and the sales are considered income from said activity (sale of inventory). If such organization of means does not exist, the income obtained is considered capital gains or losses due to the variation in the value of the assets. The existence of this organization is a matter of fact that must be proven before the Administration.
