VAT must be settled in the period of incurrence, regardless of invoice issuance date

A crane company asks when VAT should be declared when an insurer issues invoices months after the incurrence period. The DGT states that VAT must be declared in the period of incurrence and that the service provider is responsible for issuing the invoice.

The question raised

Question raised. The issue is raised as to when Value Added Tax must be settled in said operations and who incurs liability for failing to comply with the invoice issuance deadline.

The DGT's ruling

The taxable person must settle the tax in the declaration period in which the accrual occurs, regardless of the invoice issuance date. The obligation to issue the invoice rests with the entrepreneur, who is responsible for compliance even if the material issuance is carried out by a third party on their behalf. If the recipient is an entrepreneur or professional, the invoice must be issued before the 16th day of the month following the accrual.
