Two contiguous dwellings joined internally are considered a single habitual residence

A taxpayer inquired whether two contiguous dwellings joined internally could both be classified as habitual residences. The DGT ruled that if they are inhabited permanently and throughout the entire year, they would be considered only one habitual residence.

The DGT's ruling

Para que una edificación sea vivienda habitual debe estar acondicionada como tal y cumplir requisitos de titularidad, residencia efectiva y permanencia. Si dos viviendas son contiguas, están unidas interiormente y se habitan de forma permanente por los propietarios, únicamente se entendería que existe una vivienda habitual.
