Home ownership investment deduction requires construction to be completed within four years of investment start

A taxpayer asks whether the home ownership investment deduction can be applied after signing a property with a cooperative in 2024, having joined in 1994. The DGT responds that it is not possible because the transitional regime is not met, as more than four years have passed between the start of investment and completion of works.

The question raised

Possibility of commencing the deduction for investment in the primary residence starting from the current tax period.

The DGT's ruling

To access the transitional regime, the taxpayer must have acquired the dwelling or paid amounts prior to 2013, having applied the deduction or being entitled to it pursuant to art. 68.1.2º LIRPF. In cases of construction, the works must be completed within a period not exceeding four years from the start of the investment. The start date is when the first amount for the deduction is paid or when the amount from the housing account is transferred. Upon completion of the works after exceeding said four-year period, the transitional regime is not applicable.
