Diabetes detection tests taxed at 21% VAT as they are not for direct consumer use

A taxpayer queried the VAT rate applicable to an early diabetes detection test using a blood sample. The tax authority ruled that the standard 21% rate applies because the product is not suitable for direct use by the end consumer.

The DGT's ruling

Para aplicar el tipo reducido del 10% a productos de la categoría 30 de la Nomenclatura Combinada, estos deben ser susceptibles de uso directo por el consumidor final. Los productos de diagnóstico que se utilicen sobre una muestra del paciente no se consideran de uso directo. Por tanto, el test de detección de diabetes consultado tributa al tipo general del 21%.
