Determination of tax residence and the taxation regime for teleworkers with a foreign payer

A worker returning to Spain after living in the US sought clarification on whether income earned from remote work for a US company should be taxed in Spain and if US taxes paid could be deducted. The DGT ruled that, as the work is physically performed in Spain, the income is subject to taxation only in Spain.

The question raised

Question raised: Taxation of income obtained from the United States during 2015: whether it must be taxed under Personal Income Tax and the possibility of a double taxation deduction, or the obligations of the taxpayer in relation to Non-Resident Income Tax.

The DGT's ruling

Si la consultante es residente fiscal en España, las rentas del trabajo obtenidas por teletrabajo desde su domicilio en España se consideran ejercicio de empleo en territorio español. Según el Convenio entre España y EE. UU., estas rentas solo tributan en España, independientemente de que el pagador sea una empresa estadounidense. Por tanto, no procede la deducción por doble imposición internacional en el IRPF por el impuesto satisfecho en EE. UU., aunque se puede solicitar la devolución en dicho país.
