Non-professional foreign exchange trading profits classified as capital gains or losses

A taxpayer asks whether non-professional foreign exchange trading profits should be declared as capital income. The DGT responds that, as not constituting an economic activity, such profits are considered capital gains or losses.

The question raised

In the event of obtaining positive results, where should they be reported in the income tax return: should they be reported as income from movable capital?

The DGT's ruling

As long as no economic activity is carried out, differences resulting from the exchange of foreign currency to national currency generate a capital gain or loss pursuant to Article 33 of Law 35/2006. The exchange rate shall be the one in force at the time of the transfer or reimbursement. If foreign currency is received instead of euros, the result shall be imputed at the time of actual collection or payment.
