Selling chemical products to homeowners' associations or maintenance companies constitutes retail trade

A query was raised regarding whether the sale of swimming pool chemicals to homeowners' associations and maintenance companies is classified as retail trade. The Directorate-General for Taxes (DGT) ruled that it is, as these products are considered intended for final consumption.

The question raised

Question posed: Is the sale to homeowners' associations with swimming pools and the sale to limited liability or public limited companies dedicated to swimming pool maintenance considered a retail sale?

The DGT's ruling

Retail trade is that carried out for direct use or consumption. Sales to homeowners' associations are retail because they will use the products in their own facilities. Likewise, sales to maintenance companies are retail because they will use the products in the normal course of their activity, being considered products intended for final consumption.
