Insurance claim for property damage creates gain or loss

A property owner asks how to tax an insurance payout after an explosion destroyed their building. The DGT responds that the gain or loss must be calculated as the difference between the insurance payout and the property's acquisition value (excluding the land value).

The DGT's ruling

The insurance indemnity generates a capital gain or loss calculated as the difference between the amount received and the proportional part of the acquisition value of the damaged asset, excluding the land value. This result is included in the savings tax base. Demolition expenses to clear the land of ruins are considered investments or improvements that increase the acquisition value of the land for future transfers.
