Acquisition value of property obtained via purchase option includes option price plus expenses

A taxpayer has requested clarification on how to calculate the acquisition value of a property after exercising a purchase option in a financial lease. The Directorate General for Taxes (DGT) has ruled that this value shall consist of the purchase option amount plus any expenses and taxes inherent to the acquisition, excluding interest.

The question raised

Acquisition value of the aforementioned real estate for the purposes of calculating the capital gain or loss in Personal Income Tax (IRPF) in the event of a future transfer thereof.

The DGT's ruling

The acquisition value of the real estate shall consist of the sum of the actual amount paid for the acquisition (the purchase option price) and the expenses and taxes inherent to the acquisition, excluding interest. As the real estate has not been used for economic activities, it shall not be reduced by depreciation.
