Reinvestment exemption for principal residence may apply if legal and reinvestment deadlines are met

A taxpayer has enquired whether they can claim the reinvestment exemption after selling their principal residence, which they vacated in 2019 for work reasons. The Directorate General for Taxes (DGT) clarifies that this is possible provided the sale occurs within two years of ceasing residence (with the period adjusted due to the suspension of Royal Decree-Laws during COVID-19) and the proceeds are reinvested in a new principal residence.

The DGT's ruling

Para aplicar la exención, la vivienda transmitida debe haber sido habitual en el momento de la venta o en cualquier día de los dos años anteriores. El plazo de dos años para la venta se computa desde que se dejó de residir en la vivienda, teniendo en cuenta la paralización de plazos por el COVID-19 entre el 14 de marzo y el 30 de mayo de 2020. Asimismo, el importe obtenido debe reinvertirse en una nueva vivienda habitual en un plazo no superior a dos años desde la transmisión.
