Notoriety acts are subject to ITP if previous transfer tax payment is not proven

A taxpayer inquired whether a notoriety act is exempt from Transfer Tax (ITP) given that tax had already been paid upon the purchase of the plot. The Directorate General for Taxes (DGT) responded that the purpose of a notoriety act is to remedy the absence of a title from a previous transfer; therefore, it is subject to taxation unless proof of payment for said prior transfer is provided.

The question raised

Cuestión planteada Si el acta de notoriedad estaría exenta del sobre Transmisiones Patrimoniales y Actos Jurídicos Documentados al haber tributado ya la adquisición del bien por dicho impuesto, como se hace constar expresamente en el referido documento notarial.

The DGT's ruling

Las actas de notoriedad se consideran transmisiones patrimoniales sujetas al impuesto, a menos que se acredite haber satisfecho el impuesto o la exención por la transmisión cuyo título se supla. El acta de notoriedad no tiene por objeto la transmisión actual del consultante, sino la transmisión anterior que permitió la titularidad de quien le vendió. Por tanto, se debe tributar por esa transmisión anterior si no se acredita su liquidación.
