Purchasing rural land for livestock farming is not a deductible expense

A livestock civil society has enquired whether the acquisition of rural land for its operations constitutes a deductible expense or a depreciable investment asset. The Directorate General for Taxes (DGT) has ruled that while the land is an asset used for the business activity and not an expense, it is not subject to depreciation.

Cuestión planteada Si la compra del terreno rústico es gasto deducible de la actividad o debe ser un bien de inversión.

The DGT's ruling

Los bienes inmuebles donde se desarrolla la actividad se consideran elementos patrimoniales afectos a la misma, por lo que el terreno rústico no puede tratarse como gasto deducible. Asimismo, los terrenos no son amortizables, por lo que no se puede imputar gasto por esta vía.
