FOGASA income must be reported in the year it accrues and is not eligible for the irregular income reduction

A retired architect enquired whether payments received from the Wage Guarantee Fund (FOGASA) should be reported in the year of dismissal or the year of receipt, and whether the 30% reduction for irregular income could be applied. The Directorate-General for Taxes (DGT) ruled that income must be reported in the year the benefit accrues and that the reduction does not apply as it is not a regulated scenario.

The question raised

The DGT's ruling

El importe percibido de FOGASA se califica como rendimiento de actividades económicas. Debe imputarse al período impositivo en que se devenga la prestación, independientemente del cobro. No es posible aplicar la reducción del 30% por rentas irregulares, ya que la prestación no encaja en los supuestos reglamentarios del artículo 25 del RIRPF ni tiene un período de generación superior a dos años.
