Properties leased may be exempt from Wealth Tax if specific conditions met

A taxpayer asks whether properties used for rental are exempt from Wealth Tax. The DGT states that the activity must be economic, carried out regularly, personally and directly, and must be the main source of income.

The question raised

Whether the real estate assets used for the economic activity of leasing are exempt pursuant to Article 4.Eight.One of Law 19/1991, of June 6, on Wealth Tax

The DGT's ruling

For the exemption, the lease must be an economic activity through the use of at least one employee with a full-time employment contract. The activity must be carried out in a habitual, personal, and direct manner, with the taxpayer assuming management decisions. Furthermore, it must constitute the main source of income, understood as 50% of the Personal Income Tax taxable base.
