Dissolution of joint property with unavoidable excess adjudication is not subject to IIVTNU

A query was raised regarding whether allocating a property to a single co-owner, while providing financial compensation to the others, triggers the tax on the increase in value of urban land. The DGT ruled that if the excess is unavoidable due to the indivisibility of the asset, no transfer of assets occurs, and therefore the tax is not due.

The DGT's ruling

La disolución de la comunidad de bienes no es una transmisión patrimonial si el comunero recibe solo su cuota proporcional. Si existe exceso de adjudicación, este constituye una transmisión onerosa o gratuita sujeta al IIVTNU, salvo que el exceso sea inevitable por la indivisibilidad del bien y se compense en metálico a los demás. En este caso, al ser un único bien indivisible, no se produce el hecho imponible del IIVTNU.
