Economic motives for a merger may justify applying the special regime under the CIT Act

A company has enquired whether a merger by absorption involving participated companies can qualify for the special regime under the Corporate Income Tax (CIT) Act and whether its economic motives are valid. The Directorate General of Taxes (DGT) has ruled that if the transaction meets both commercial and CIT Act requirements, it may qualify for the regime, considering the stated economic motives to be valid.
