Defence and security contractors: classified information protection requirements in contracts with Spain or Canada

The Agreement between Spain and Canada establishes a cooperation framework for the reciprocal protection of classified information shared between both Governments. The agreement regulates information management, security clearances for both facilities and individuals, and the obligations of contractors handling sensitive data (Art. 1). It aims to ensure that access to such information is strictly limited to the 'need-to-know' principle and subject to rigorous security controls (Art. 1.g).

In 3 key points

  1. Classified contracts must include a description of security requirements and the classification level (Art. 1.b). (art. 1.b)
  2. Access is limited to individuals with personal security clearance (PSC) and a need-to-know (Art. 1.d.i). (art. 1.d.i)
  3. Disclosure of information to third countries is prohibited without the written consent of the Originating Party (Art. 1.d.viii). (art. 1.d.viii)
