30 days for registrar to inscribe alternative georeferenced graphical representation in case of identity doubts

The resolution establishes that when there are doubts about a property's identity and a municipal report has been issued, the claimant may request the registration of an alternative georeferenced graphical representation. This procedure is regulated under article 199.2 of the Mortgage Law. Previously, there was no clear mechanism to resolve identity doubts through an alternative graphical representation.

In 2 key points

  1. An alternative georeferenced graphical representation may now be registered in cases of doubt regarding property identity (art. 199.2 Ley Hipotecaria)
  2. The appeal must be submitted through a private instance with notarial signature (texto del recurso presentado el 28 de marzo de 2025)

How it affects those involved

Landowners in Marbella who have doubts about the identity of their property can now request the registration of an alternative georeferenced graphical representation, improving clarity in the official property description. Registrars must assess and act upon this within 30 days. Property advisors must verify that the municipal report has been issued in order to submit the appeal. The process enables greater accuracy in the representation of the property.
