CIBER and Gregorio Marañón Hospital: agreement for research and training in rare diseases

The Biomedical Research Network Consortium (CIBER) and the Gregorio Marañón General University Hospital have signed an agreement to carry out biomedical research and training activities in the field of Rare Diseases. The agreement stipulates that the ownership, management, and exploitation of research results shall belong to the research group's home institution and CIBER, in accordance with Patent Law 24/2015. Researchers must report any results susceptible to economic exploitation prior to disclosure to initiate protection procedures (Art. 24/2015).

In 2 key points

  1. Ownership and exploitation of results shall be governed by Patent Law 24/2015 (Ley 24/2015)
  2. Obligation to report exploitable results prior to their disclosure (Ley 24/2015)

How it affects those involved

For the linked research groups, the agreement defines the industrial property regime for the results obtained, requiring them to notify any exploitable findings before disclosure to ensure the protection of rights (Law 24/2015). CIBER is obliged to immediately inform the ISCIII of any results funded by it that may lead to industrial property applications. In the event of a lack of agreement regarding rights management, majority rules based on the entities' participation will apply.
