Convicted offenders for property crimes: 5 years imprisonment for recidivism, 5-year period from first conviction

Organic Law 1/2026 modifies recidivism rules for property crimes, increasing penalty to five years imprisonment for offenders committing such crimes within five years of their first conviction (arts. 22, 234.2, 235.1, 248, 250.1, 255, 568). Applies to crimes such as robbery, theft, and damage to property. Also modifies articles 13, 105, and 544 bis of the Criminal Procedure Law.

In 3 key points

  1. 5-year prison sentence for repeat property offences (art. 22)
  2. 5-year evaluation period from first conviction (art. 234.2)
  3. Applies to offences such as robbery, theft and damage to property (art. 255)

How it affects those involved

Judges must assess a five-year period from the first conviction to determine repeat offending; penal authorities must update conviction records to meet the new evaluation period. The criminal justice system's application of repeat-offender penalties is affected.
