Rejection of private allegations: private submissions cannot be used to challenge land registrations

The Directorate General for Legal Certainty and Public Faith has confirmed the rejection of a private submission of allegations filed against a property registration (Art. 205 LH). The Registrar determined that a private document does not constitute a registrable title nor a valid means for making ex ante or ex post allegations in this procedure, unless exceptionally permitted by law (Art. 205 LH).

In 2 key points

  1. Private submissions of allegations are not registrable titles in the Land Registry (Motivo)
  2. Inadmissibility of private allegations against registrations under the regime of Art. 205 LH (Motivo)

How it affects those involved

For individuals wishing to challenge registrations through private submissions of allegations, this ruling establishes that such submissions will not be admitted for processing as they lack the nature of a registrable title (Art. 205 LH). The risk for affected parties is a lack of legal protection if they fail to use legal channels involving public documents or the specific procedures provided for in the Mortgage Law for challenging entries.
