Owners of tourist rental properties: registration number assignment suspended if local planning requirements are not met

The Directorate General for Legal Certainty and Public Faith has confirmed the suspension of the assignment of a short-term tourist rental registration number in Jaca. This decision follows the applicant's failure to prove compliance with the urban planning requirements set out in the General Urban Development Plan (PGOU) for tourist rental properties (Art. 9 of the Royal Decree on the single registry). The registrar requires documentation proving the necessary enabling title for the intended use in accordance with local planning regulations (Art. 9).

In 2 key points

  1. The registration application must include the document proving the enabling title required for the intended use according to local regulations (Art. 9) (art. 9)
  2. The single lease registry shall be carried out through the Land Registry or the Personal Property Registry (Art. 8) (art. 8)

How it affects those involved

For owners of properties intended for tourist rental, obtaining a single registration number through the Land Registry is conditional upon prior compliance with local urban planning regulations (Art. 9). The residential nature of the property alone is insufficient; if the local PGOU requires specific licences for tourist accommodation, their absence will prevent registration in the single lease registry (Art. 9).
