High Court of Justice of the Valencian Community: new distribution rules for the Social Chamber

The High Court of Justice of the Valencian Community has approved the rules for the distribution of cases within its Social Chamber. Proceedings will be assigned to judges in correlative order within specific groups, covering matters ranging from collective redundancies to Social Security (Art. 1). Exceptions have been established to ensure continuity in nullity appeals, clarifications, and the enforcement of judgments (Art. 2).

In 3 key points

  1. Cases will be distributed in correlative order within specific groups (e.g., redundancies, Social Security, appeals against judgments), Art. 1. (art. 1)
  2. Continuity of the reporting judge is maintained for nullity incidents, clarifications, and the enforcement of judgments without consuming a turn, Art. 2.B and 2.C. (art. 2.B y 2.C)
  3. Turns for challenges and recusals will be ordered according to seniority on the judicial scale, Art. 3. (art. 3)

How it affects those involved

For litigants in the Valencian Community (companies, employees, and public administrations), the rule guarantees predictability in the assignment of judges based on the subject matter of the proceedings (Art. 1). The existence of exceptions to the distribution (Art. 2) ensures that incidents and the enforcement of judgments are resolved by the same reporting judge who issued the original ruling, preventing the fragmentation of criteria and procedural delays.
