Tourist rentals in Madrid: municipal licence mandatory to obtain single registration number

The Directorate General for Legal Certainty and Public Faith confirms that registration in the Community of Madrid's regional register is insufficient to obtain a short-term rental registration number. To comply with Royal Decree 1312/2024, it is mandatory to provide a municipal planning licence for activity and operation, or a responsible declaration with a favourable resolution from the Madrid City Council (Art. 9.5 RD 1312/2024).

In 2 key points

  1. Requirement of a municipal licence or a favourable responsible declaration from the Madrid City Council for registration (Art. 9.5 RD 1312/2024). (art. 9.5.º RD 1312/2024)
  2. Regional registration must be accompanied by the granting of a municipal licence (Art. 5.1 and 17.1 Decree 79/2014 CM). (art. 5.1 y 17.1 Decreto 79/2014)

How it affects those involved

For owners of tourist accommodation in Madrid, mere registration in the Community of Madrid's Tourism Business Register does not guarantee the assignment of a single registration number. Hosts must ensure they have previously obtained a municipal licence or a favourable responsible declaration from the Madrid City Council to avoid the suspension or denial of registration (Art. 9.5 RD 1312/2024).
