Owners of tourist rentals: express community approval required to obtain registration number

The General Directorate of Legal Certainty and Public Faith confirms that the assignment of the tourist rental registration number by the Property Registrars requires compliance with civil and administrative requirements. According to the Horizontal Property Law, express approval from the community of owners is mandatory to carry out this activity pursuant to art. 17.12 LPH (art. 7.3 LPH). Without this unique registration number, the property cannot be offered on short-term rental platforms.

In 3 key points

  1. Requirement for express approval from the community of owners to carry out tourist activities, Art. 7.3 LPH (art. 7.3 LPH)
  2. 7 working day period to rectify defects following a negative notification to avoid suspension of the registration number (nota de calificación)
  3. The absence of a registration number prevents offering properties on short-term rental platforms (Fundamentos de Derecho)

How it affects those involved

For owners of properties intended for tourist rentals, the lack of express approval from the community of owners prevents obtaining the registration number required to operate legally on online platforms (Art. 7.3 LPH). Communities of owners gain the power to control and condition this activity through express agreements (Art. 17.12 LPH). Failure to comply with requirements or failure to rectify them within 7 working days may result in being barred from access to rental platforms (qualification note).
