Plant variety rights: extinction of plant breeders' rights due to holder renunciation

This Order provides for the extinction of plant breeders' rights for various varieties of species, including cotton, broad bean, bean, maize, peach, melon, orange, and olive, following renunciation by their holders (Art. 28.1 Law 3/2000). This extinction results in the automatic cancellation of the corresponding titles in the Register of Protected Varieties (Art. 28.3 Law 3/2000).

In 2 key points

  1. Extinction of rights due to holder renunciation and cancellation in the Register of Protected Varieties, Art. 28.1 and 28.3 Law 3/2000 (art. 28.1 y 28.3 de la Ley 3/2000)
  2. The Order shall take effect on the day following its publication in the BOE (disposición final)

How it affects those involved

For the holders of the varieties listed in the Annex, the regulation formalises the loss of their property rights over said plant varieties due to their express renunciation. It does not create new obligations for the rest of the agricultural sector, but rather updates the Register of Protected Varieties with the requested cancellations.
