Financial sector obliged entities: AML systems must adapt to new EU and FATF standards

Royal Decree 813/2026 updates anti-money laundering and countering the financing of terrorism (AML/CFT) regulations to comply with FATF requirements and Directive (EU) 2024/1640. The regulation introduces changes to consolidated supervision, issuer transparency, and risk management. Furthermore, it allows Third Sector entities to provide information regarding financial exclusion risks to facilitate access to basic payment accounts.

How it affects those involved

For financial institutions and obliged entities, the regulation requires an update of prevention methodologies in response to new technological risks and international standards. Non-profit entities within the National Reception System or the Third Sector gain an exceptional capacity to certify the economic vulnerability of their users to credit institutions (context of art. 67 bis/ter). The Bank of Spain strengthens its consolidated supervision capacity over groups of entities, including unregulated subsidiaries and significant branches (amended art. 6 of RD 84/2015).
