Galician Government: limitation of popular action in sports matters subject to victim's authorisation

The State-Galicia Bilateral Cooperation Commission has resolved jurisdictional disputes regarding Law 3/2025 of the Autonomous Community of Galicia. It has been agreed that the Xunta de Galicia may only exercise popular action in the sporting sphere if it complies with the framework of Article 109 bis.3 of the Criminal Procedure Law, always requiring the authorisation of the victim (Annex, section I).

In 2 key points

  1. The Xunta de Galicia's popular action requires the victim's authorisation (Annex, section I). (Anexo, apartado I)
  2. Intervention must be consistent with Article 109 bis.3 of the Criminal Procedure Law (Annex, section I). (Anexo, apartado I)

How it affects those involved

For the Xunta de Galicia, the agreement limits its capacity for procedural intervention in sports matters, conditioning its popular action on general procedural regulations and the victim's will (Annex, section I). For victims of infractions in the sporting sphere, it ensures that their intervention is respected in accordance with the requirements of the Criminal Procedure Law (Annex, section I).
