Resolution by the Directorate General for Legal Certainty and Public Faith regarding an appeal against a land registry entry in Lugo

The Directorate General for Legal Certainty and Public Faith has ruled on an appeal filed by an adjacent landowner against an entry made by the Land Registrar of Lugo No. 1. The dispute arose following the processing of a Land Registry-Cadastre coordination file (Art. 199.1 of the Mortgage Law), which resulted in a reduction of the area of registered property 48.155 by 105.375 square metres.

In 2 key points

  1. Reduction of the area of registered property 48.155 by 105.3750 square metres, Art. 199.1 of the Mortgage Law (art. 199.1 Ley Hipotecaria)
  2. The registration aims to align the registered area with the cadastral area (Hechos II, apartado a)

How it affects those involved

For the appellant (the adjacent landowner), the resolution confirms the validity of the reduction in the area of the property subject to registration, as their arguments against the Land Registry-Cadastre coordination were dismissed. For the owners of the property, the new area of 714 square metres is consolidated in accordance with the georeferenced graphic representation.
