National High Court: automation of case assignment in the Criminal Chamber to prevent Presidential intervention

The rules for case assignment within the Criminal Chamber of the National High Court have been amended to automate the allocation of certain proceedings (Art. 152.1.1.º LOPJ). The change ensures that the registry office determines the responsible section via a computer application and random assignment, removing the need for Presidential intervention in cases involving international judicial assistance, transfer of jurisdiction, recusal, and conflicts of interest. In instances of incompatibility between sections, the system will allow the affected section to be excluded so that the remaining cases are assigned randomly.

In 2 key points

  1. Automation of case assignment for international judicial assistance, transfer of jurisdiction, recusal, and conflicts of interest (propuesta del Presidente de la Sala de lo Penal)
  2. Entry into force on the day following its publication in the BOE (propuesta del Presidente de la Sala de lo Penal)

How it affects those involved

For litigants and parties in criminal proceedings, the measure aims to provide greater agility and neutrality in the assignment of cases that previously required direct intervention from the Chamber's Presidency (Art. 152.1.1.º LOPJ). Judicial administration optimises the process by automating five specific types of proceedings, thereby reducing discretion in the assignment of sections.
