Short-term rental registration number denied due to encroachment on maritime-terrestrial public domain

The Directorate General for Legal Certainty and Public Faith has confirmed the refusal of a unique short-term rental registration number requested by the company «Begur Alta House, S.L.» (Facts I). The refusal is based on the fact that the main property encroaches upon the maritime-terrestrial public domain on its north-eastern boundary, according to the analysis of cadastral mapping and the public domain line (Facts II). Registration will only be possible if a geometry respecting said line is provided or an enabling title for occupation is presented (Legal Grounds).

In 2 key points

  1. Refusal due to the property's intersection with the maritime-terrestrial public domain (Fundamentos de Derecho)
  2. Rectification through the provision of compliant geometry or an enabling title in GML format (Fundamentos de Derecho)

How it affects those involved

For the applicant company, the refusal prevents obtaining the registration number required for short-term rental activities on the affected property. The defect can be rectified by providing a graphic representation in GML format that respects the public domain delimitation or by proving an enabling title to occupy said strip (Legal Grounds).
