Social Housing: Ban on tourist rentals, including room rentals

The Directorate-General for Legal Security and Public Faith confirms that it is impossible to assign a tourist rental registration number to a room within a property subject to the Social Housing Regime (art. II of the qualification note). Decree 28/2016 expressly prohibits social housing from being used for tourist purposes, whether as a whole unit or by individual rooms (art. 1.3.a).

In 2 key points

  1. Ban on tourist use of social housing, both for entire properties and individual rooms (art. 1.3.a Decree 28/2016). (art. 1.3.a)
  2. A registration number is mandatory to offer short-term rentals on online platforms (Royal Decree 1312/2024). (Real Decreto 1312/2024)

How it affects those involved

For owners of social housing (VPO), the prohibition on exploiting properties or partial units (rooms) for short-term or tourist rentals is ratified (art. 1.3.a Decree 28/2016). Non-compliance with this restriction prevents obtaining the registration number required to offer accommodation on online platforms, in accordance with the framework of Royal Decree 1312/2024.
