Central Administrative Tribunal for Contractual Appeals gains jurisdiction over special appeals in public procurement

A new chamber is established within the Central Administrative Tribunal for Contractual Appeals to handle special appeals regarding public procurement. This jurisdiction applies to acts by contracting authorities of the General State Administration and seven autonomous communities, as well as Ceuta and Melilla, in accordance with signed agreements (Art. 1). The scope is defined by the final paragraph of Art. 45.1 of Law 9/2017 (Art. 1.2).

In 3 key points

  1. A new chamber is created within the Central Administrative Tribunal for special appeals (art. 1)
  2. Jurisdiction over acts by contracting authorities in 8 entities (art. 1.1)
  3. Legal basis: Law 9/2017, Art. 45.1, first paragraph, final part (art. 1.2)

How it affects those involved

Public administrations managing procurement in the specified communities must organise their appeals through the new tribunal. Contractors and interested parties may submit special appeals to this body. While there are no changes to deadlines or costs, the scope of the appeal process is expanded through greater territorial coverage (Art. 1).
