Madrid tourist accommodation owners: municipal licence mandatory to obtain rental registration number

The Directorate General for Legal Certainty and Public Faith confirms that to be assigned a short-term rental registration number in the Community of Madrid, it is mandatory to provide a municipal planning licence for activity and operation, or a responsible declaration with a favourable resolution from the Madrid City Council (legal grounds one). Mere registration in the regional Tourism Business Register does not substitute the requirement for a municipal licence (legal grounds one). This requirement is based on Decree 79/2014 of the Community of Madrid and Royal Decree 1312/2024 (legal grounds one).

In 2 key points

  1. A municipal activity licence or a responsible declaration with a favourable resolution from the Madrid City Council is required (legal grounds one). (fundamentos de derecho uno)
  2. Registration in the regional register does not exempt one from the obligation to obtain a municipal licence (legal grounds one). (fundamentos de derecho uno)

How it affects those involved

For owners and managers of tourist accommodation in Madrid, regional registration is insufficient to comply with the Single Rental Registry; municipal validation is mandatory (legal grounds one). Failure to meet this requirement results in a negative assessment by the Land Registrar and the suspension of the assignment of the registration number required for the activity (facts II).
