Spain ratifies UN Convention on the international effects of judicial sales of ships

Spain has expressed its consent to be bound by the United Nations Convention on the International Effects of Judicial Sales of Ships (Art. 1). This regulation aims to establish uniform standards to ensure that judicial sales of ships resulting in a clean title (free of mortgages or encumbrances) are internationally valid (Art. 1 and 2.c). The objective is to protect buyers and enhance legal certainty in international maritime trade.

In 3 key points

  1. The convention governs judicial sales that confer a clean title, free of mortgages or encumbrances (Art. 1 and 2.c). (art. 1)
  2. Courts must dismiss or lift precautionary attachments if the judicial sale certificate is produced (Art. 8.1 and 8.2). (art. 8.1)
  3. The authority to annul or suspend a judicial sale rests exclusively with the judicial bodies of the State of sale (Art. 9.1). (art. 9.1)

How it affects those involved

For shipowners and creditors, the regulation seeks to ensure that judicial sales conducted under court supervision are internationally recognised, facilitating the clearing of charges and encumbrances (Art. 2.c). Buyers of ships at judicial auctions gain greater legal certainty by receiving a title free of mortgages (Art. 1). Courts in State Parties must dismiss or lift precautionary attachments if the relevant judicial sale certificate is presented (Art. 8.1 and 8.2).
