Claimants with adjacent neighbours' opposition: 30 days to appeal to Legal and Public Records Directorate

The March 17, 2026 resolution states that when the Administration or neighbouring parties oppose the registration of an alternative georeferenced graphical representation, the claimant may file an appeal with the Directorate General of Legal and Public Records within 30 days of receiving the rejection (Art. 199.2 Mortgage Law). This mechanism provides a formal appeal route against opposition from third parties, particularly the Administration, in land description correction procedures.

  1. Applicants facing objections from neighbours: 30 days to file an appeal with the General Directorate (art. 199.2 Ley Hipotecaria)

How it affects those involved

Applicants for the registration of georeferenced graphical representations can now appeal to the General Directorate in the event of objections from neighbouring parties, including the Administration. This strengthens property rights protection against administrative barriers. Local authorities may see an increase in formal appeals. Property advisors should inform their clients about this new time limit and appeal procedure.
