Refusal of presentation entry: private documents without registration relevance cannot be recorded

The Directorate General for Legal Certainty and Public Faith has upheld a registrar's refusal to make a presentation entry for a private document addressed to a Court. It has been established that private documents that lack legal registration effectiveness or cannot trigger any registration operation are not eligible for a presentation entry (Articles 420.1 and 420.3 of the Mortgage Regulations).

In 3 key points

  1. A presentation entry shall not be made for private documents lacking legally attributed registration effectiveness, Art. 420.1 Mortgage Regulations. (art. 420.1 Reglamento Hipotecario)
  2. The entry shall be refused if the document, by its nature or purpose, cannot trigger a registration operation, Art. 420.3 Mortgage Regulations. (art. 420.3 Reglamento Hipotecario)
  3. Two-month period to appeal via a claim before the Civil Court from the date of notification, Art. 325 and 328 Mortgage Law. (art. 325 y 328 de la Ley Hipotecaria)

How it affects those involved

For individuals and professionals, this ruling confirms that the Land Registry is not a reception channel for documents addressed to other administrations (such as Courts) if they lack registration content. Using the Registry for procedures unrelated to the registration of real rights lacks legal effect and will be refused by the registrar (Article 246 of the Mortgage Law).
