Claimants can demand registration of georeferenced graphical representation within 30 days if land subdivision is concealed

The February 4, 2026 Resolution allows claimants to demand registration of a georeferenced graphical representation when land subdivision concealment is detected, based on municipal reports. This mechanism activates under Article 199.2 of the Mortgage Law, following a private claim by the property owner. The resolution period is 30 natural days from submission (art. 3).

In 2 key points

  1. A georeferenced alternative graphical representation may be registered in cases of parcelation concealment (art. 3)
  2. The time limit for resolving the appeal is 30 natural days from the date of submission (art. 3)

How it affects those involved

Owners of properties affected by parcelation concealment may request the correction of their property description through a georeferenced graphical representation. Municipalities must provide the graphical validation report as a basis for the appeal. Notaries and land registration offices must assess appeals within a 30-day period. Advisors must inform their clients of their right to file such an appeal if parcelation concealment is detected.
