The Agreement establishes the allocation of competencies among the three functional sections of the Administrative Litigation Chamber of the High Court of Justice of Andalusia, Ceuta and Melilla in Málaga. The First Section will handle regional/local taxes, fundamental rights, and competition law; the Second Section will handle state taxes, social security, and public procurement; and the Third Section will handle urban planning, the environment, and compulsory purchase. Immigration matters will be distributed by number among all magistrates.

In 3 key points

  1. First Section: Regional/local taxes, fundamental rights, and competition law. (Sección Primera)
  2. Second Section: State taxes, Social Security, and Public Procurement. (Sección Segunda)
  3. Third Section: Urban Planning, Environment, Compulsory Purchase, and Subsidies. (Sección Tercera)

How it affects those involved

For companies and individuals involved in litigation in Málaga, the regulation organises the specialisation of judicial sections according to the subject matter of the dispute. Litigation regarding state taxes or social security will be processed in the Second Section, while urban planning or environmental cases will go to the Third Section. Immigration cases do not have a fixed section but are instead distributed equally among the entire body of magistrates.
