Colindantes have three months to submit objections or they will be deemed late

The resolution states that neighbours must submit objections within three months of the registration of a georeferenced graphical representation, otherwise they will be considered late. This period is set out in Article 199.2 of the Mortgage Law and applies to procedures where such representation is registered. The change means neighbours must act promptly to avoid objections being rejected for lack of timely submission.

In 2 key points

  1. Neighbouring parties' objections must be submitted within a three-month period, otherwise they are considered late (art. 199.2 Ley Hipotecaria)
  2. The registration of the georeferenced graphical representation activates the three-month period for objections (art. 199.2 Ley Hipotecaria)

How it affects those involved

Neighbouring parties with an interest in regulatory procedures must submit their objections within three months of the registration of the georeferenced graphical representation; otherwise, they will be excluded. Registration authorities may proceed with registration without considering any subsequent objections. Property advisors must inform their clients of the deadline and the necessity of acting promptly to avoid their objections being rejected for being submitted late.
