How the DGT's position has evolved
Current position
To apply the deduction for energy efficiency works, certificates must be issued and registered in accordance with Royal Decree 390/2021. The right to the deduction arises in the tax period in which the certificate is issued following the works. The registration entry may occur after the execution of the works or after the date of issuance without invalidating the certificate.
The DGT's position has shifted from focusing on the issuance date of the certificate following the works to strictly requiring compliance with Royal Decree 390/2021, including registration. It has been clarified that the registration of the certificate prior to the works is indispensable to prove the initial efficiency, but that a delay in registration does not invalidate the issuance date for the purposes of the deduction.
Turning points
-
Introduces the necessity for the certificate to be registered according to Royal Decree 390/2021 to prove the efficiency prior to the works.
-
Clarifies that the one-month submission period for registration is not a substantive requirement for the application of the deduction.
