Current position

Pension plan benefits are considered income from employment. The 40% reduction for contributions made until December 31, 2006, is applicable to lump-sum withdrawals, provided that the terms of the twelfth transitional provision of the LIRPF (Personal Income Tax Law) are met. In the case of early withdrawal, the contingency is understood to have occurred in the tax year in which the ten-year seniority requirement is met and the withdrawal is requested.

The DGT's position remains constant regarding the nature of benefits and the application of the 40% reduction. The most recent rulings have clarified the timing of accrual for the early withdrawal of rights and the limits of special tax regimes for persons with disabilities. No changes in the base criterion are observed, but rather technical clarifications regarding deadlines and contingencies.
