How the DGT's position has evolved
Current position
The execution of hydraulic infrastructure works for the distribution and storage of granted waters constitutes a water distribution activity subject to IVA (Value Added Tax). The cost of these works, together with the supply fee, forms part of the taxable base of the operation. The reduced tax rate of 10% applies to waters suitable for irrigation, and the deduction of IVA paid is permitted.
The DGT's position has moved from considering the improvement fee as a non-subject activity, following a change in criterion regarding the binding ruling V0939-11, to consolidating the subjectability to IVA of infrastructure works. Currently, it is established that these works form part of the taxable base for water distribution, allowing for the application of the reduced rate and the right to deduction.
