Timing of public sector salary increases for Personal Income Tax (IRPF) purposes

The Dirección General de Tributos (DGT) has issued a relevant criterion regarding the timing of the imputation of employment income for public sector employees. The issue focuses on determining in which tax year salary increases that depend on macroeconomic indicators, such as Gross Domestic Product (GDP) or the Harmonised Index of Consumer Prices (HICP), must be taxed.

What the DGT has resolved

The tax authority establishes that the imputation of employment income must take place in the tax period in which it becomes enforceable for the recipient. In this sense, the DGT determines that increases linked to the 2023 GDP should not be taxed in the 2023 tax year, but rather in 2024. This is because enforceability occurs in 2024, once the INE (National Statistics Institute) data is published and the Council of Ministers' Agreement is formalized.

Similarly, increases conditioned on the 2024 HICP will become enforceable in 2025, following the fulfillment of legal requirements and the publication of the corresponding Agreement in the Official State Gazette (BOE). The criterion emphasizes that these are not types of income that the employee could have demanded in the reference year and were simply received with a delay.
