The three-year period for a primary residence will count from occupation if not inhabited during the first year

Determining the exact moment a home acquires the status of a primary residence is a decisive factor for the application of tax exemptions, especially in cases of reinvestment. The Dirección General de Tributos (DGT) has specified the calculation rules for this three-year period required by the Personal Income Tax (IRPF) regulations.

What the DGT has resolved

The ruling establishes that, for a property to be considered a primary residence, it must be effectively and permanently inhabited for a minimum period of three years. However, the start of this calculation depends on when the actual occupation of the property occurs following its acquisition:

  • If occupation is immediate: If the home is effectively inhabited within the twelve months following the date of acquisition, the three-year period is calculated from the date of purchase.
  • If occupation is delayed: If effective occupation occurs after the first twelve months from acquisition have passed, the three-year period will begin to be counted from the date the said occupation begins.

What this means for you

This criterion directly affects individuals who need to prove primary residence status to apply for tax benefits, such as the reinvestment exemption. Compliance with this requirement depends not only on the legal ownership of the property but on the reality of its use and habitability. An error in calculating the three-year period could invalidate the application of the exemption in a reinvestment operation if it is not demonstrated that the minimum required time has been met from the correct calculation moment.

What you should do

It is necessary to reliably document the start date of the effective occupation of the home, especially if this does not coincide with the date of the purchase deed. Having evidence of residence (utilities, census registration, or contracts) allows you to prove the start of the calculation at the appropriate time to the Administration. Since each habitability situation is unique, it is recommended to assess the available documentation to ensure compliance with the deadlines required by the IRPF Law.
